The following Terms and Conditions (Terms & Conditions) are valid between you and The Arkow  (“us”, “we”) and apply to all use of and orders placed on The Arkow’s Website www.thearkow.com (“Website”). 

The Arkow may update these Terms and Conditions from time to time. The most recent revision date will be listed at the beginning of this page. Please note that the version in effect at the time of your purchase—i.e., the one you accepted when placing your order—will apply, not any updated version published afterward.

You are responsible for reviewing this page regularly to stay informed about any updates. By continuing to use or access the Website after changes are posted, you agree to the revised terms.

1. Placing an Order
To place an order, select the desired products and follow the checkout instructions. Once your order is submitted, you will receive an automated confirmation email acknowledging receipt. Please note that this confirmation does not constitute acceptance of your order. The contract between you and The Arkow is formed only once your order has been processed and dispatched, at which point you will receive a shipping confirmation email.
By accessing or placing an order through The Arkow’s website, you confirm that you have read and agreed to these Terms and Conditions. We also encourage you to review our Privacy Policy to understand how your data is collected and used.

2. Products & Availability
The Arkow’s collections and products are presented on our website with the aim of providing accurate descriptions, images, and details. However, we cannot guarantee that all information is error-free, and variations may occur due to differences in screen settings, lighting, or other technical factors; as a result, the colours and details shown in product images may differ slightly from the actual products, and The Arkow cannot be held liable for such minor discrepancies.
All products are subject to availability. We reserve the right to limit quantities, refuse orders, or update product information at any time, without prior notice.

3. Pricing & Payment 
All prices displayed on our website are shown in EUR. Shipping fees are not included in the product prices and will be added and charged at checkout.
For customers outside the EU, all applicable customs duties and taxes are calculated and paid upon delivery. These amounts are determined and collected by your local customs authorities and do not constitute charges imposed by The Arkow.

We accept the payment methods displayed at checkout. Payment must be made in full before orders are dispatched.
All transactions are processed in EUR, and if your payment card is in a different currency, conversion rates and fees may be applied by your bank or payment provider.

4. Returns & Right of Withdrawal
As a consumer within the European Union, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason. To exercise this right, you must notify us of your decision within the withdrawal period by contacting us at customercare@thearkow.com and providing your order details.

5. Governing Law & Dispute Resolution
These Terms and Conditions are governed by the laws of Romania. Any dispute arising in connection with these Terms and Conditions, or with the use of our website and services, shall be subject to the exclusive jurisdiction of the competent Romanian courts.
If you are an EU consumer, you also have the right to use the European Commission’s Online Dispute Resolution (ODR) platform to resolve disputes. The platform is available here: https://ec.europa.eu/consumers/odr.

6. Intellectual Property
All content featured on The Arkow Website—including but not limited to text, images, graphics, logos, design elements, audio, video, and data—is the property of The Arkow or used under appropriate authorization. These materials are protected by applicable intellectual property laws, including international copyright and trademark regulations.

By accessing our site, you are granted a limited, non-transferable right to browse and use the Website strictly for personal, non-commercial purposes. You agree not to copy, reproduce, modify, distribute, publish, display, or exploit any part of the site or its content without prior written consent from The Arkow. The following actions are strictly prohibited:

- Replicating or reselling any part of the Website or its visual layout for commercial use

7. Complaints & Defective Products
If you receive a defective or non-conforming product, please inform us as soon as possible at customercare@thearkow.com, including your order details and a description of the issue.
In accordance with Romanian and EU consumer protection laws, you benefit from a two (2) year legal guarantee of conformity starting from the date of delivery. During this period, if a product you purchased from The Arkow is found to be defective or does not match its description, you are entitled to request, free of charge:
-Repair of the product, or
-Replacement with a new product.
If repair or replacement is not possible or would be disproportionate, you may request:
-A price reduction, or
-A full refund, including shipping costs.

8. Shipping & Delivery
Delivery options, estimated timeframes, and costs are presented at checkout and may vary depending on the destination. While The Arkow makes every effort to deliver within the indicated timeframes, delays may occur due to factors beyond our control, such as customs clearance or carrier delays.
Once your order has been dispatched, you will receive a shipping confirmation email with tracking details. Responsibility for the goods passes to you upon dispatch.

9. Liability
While we strive for accuracy, The Arkow does not guarantee that product descriptions, prices, or other content are free from errors. We reserve the right to correct any inaccuracies or update information at any time.

10. Limitation of Liability
The Arkow’s liability to you is limited to what is set out in these Terms and Conditions, unless otherwise required by law. We are not liable for indirect damages, such as loss of profit, or for events beyond our reasonable control, including but not limited to war, civil unrest, government actions, strikes, lockouts, power or communication failures, natural disasters, or other comparable circumstances.
In no case will The Arkow’s liability exceed the total purchase amount of the order in question, unless otherwise required by law.
If a force majeure event occurs, The Arkow’s obligations will be suspended for the duration of the event. In such cases, either you or The Arkow may terminate the contract, in whole or in part.
